3.5% Administration Fee will be charged on any credit card payment.

Online Fees Only Apply to Online Purchases, all purchases made in person will NOT be subject to any additional fees, with the exception of #5 in these Terms & Conditions.

Live Webcast Auction Fees - 10% up to a max of $1500.00 per item.

Real Estate Fees - 5% up to a max of $3000.00 per parcel

Timed Large Equipment Auctions - 5% up to a max of $1500.00 per item

All items must be paid for in full within 3 Business Days (Monday-Friday) of the close of the auction. Invoices will be sent out within 12 hours of auction closing.

Cash, Certified Cheque, Bank Draft, Electronic Transfers, Credit Card, and Interac are acceptable.  Absolutely no removal of any equipment will be allowed until the funds have been cleared and converted to valid cash.  The auctioneer, at any time, can charge the buyer's registered credit card for full or partial payment of the items purchased at the close of the auction.

Any description regarding equipment offered for sale is believed to be true according to the information received.  The equipment and/or Real Estate will be available for presale viewing, any description is merely a guide.  Neither the auctioneer nor the owners are responsible for any errors in the description or condition.  All buyers shall inspect each item and satisfy themselves as to the condition of the items.  Failure to do so will in no way relinquish the buyer from being bound by any of the terms of this auction.  Any descriptions, whether oral, written or otherwise shall not be construed as a representation of warranty, expressed or implied.

The buyer agrees that any information posted and/or supplied by, including but not limited to images, results, customer information by the auctioneer, is for the sole purpose of the buyer participating in this auction.  This information is the sole intellectual property of the auctioneer and may not, without the written permission of the auctioneer, directly or indirectly, through any means whatsoever be used or shared for any other reason.

Until funds are cleared, the auction company has the right to secure liens and/or equipment.

There shall be no guarantees or warranties of any nature whatsoever, each and every item will be sold "as is, where is".

All sales are final.  No bidder shall retract his/her bid.

The auctioneer reserves the right to refuse any applicant for a bidding card or the privilege of bidding at any time.

After an item has been sold, it becomes the sole responsibility of the purchaser.  Once a buyer has purchased an item, all risks pass to the buyer.

Any person registering shall be responsible and liable for his bidding card/information.

The owners or the auctioneer shall not be responsible for any accidents or discomfort that occurs while attending the auction sale.

Removal - Nothing shall be removed until it is completely settled for.

Removal - The Buyer agrees that all items must be removed within 7 days of the auction.  Failure to do so may result in storage fees of $25.00/day.  If an item is not removed within 14 days of the auction sale date, the item shall be deemed as Abandoned and will be disposed of by the auctioneer at its sole discretion with NO compensation to the buyer whatsoever.

The buyers are responsible for all, but not limited to, dismantling, preparation, loading & shipping cost unless otherwise noted by the auctioneer.

The bid price does not include any applicable taxes and/or auction fees.

G.S.T will apply on applicable items.

The auctioneer has the right to remove any item for any reason at any time from the auction.

Technologies - The buyer acknowledges that the auctioneer cannot guarantee the continuous and/or secure operation or access to any "online" technologies.  All technologies are subject to, but not limited to, failure, outages and/or delays.  The auctioneer will not be held liable for any claims and/or alleged losses related to the use of any technologies or processes used in the auction.

Failure by Big Meadow Auction Services Ltd. to enforce any terms of this agreement shall in no way constitute a waiver of Big Meadow Auction Services Ltd.  rights to enforce subsequently the terms or conditions of this agreement.

Real Estate Terms & Conditions

10% Non-Refundable Down Payment on Sale Day payable to the Real Estate Brokerage.  Balance and Possession one (1) month from the date of the auction sale.  If the Balance is not received by that date, the deposit shall be forfeited as liquidation damages.
